Most litigation matters result in settlement. In some cases, the path to a final deal may be fraught with ethical dilemmas. The program will assist counsel and the judiciary to identify potential ethical problems and to discuss professional responsibilities arising during pre-trial stages of litigation including: conflicts; simultaneous representation; inadvertent disclosures; threats to initiate related proceedings; illicit discovery; mediation disclosures; and disqualification motions.
